Ngā Hua Pharmacy is committed to protecting your privacy and personal information. This Privacy Policy outlines how we collect, use, disclose, and protect your personal information in accordance with the Health Information Privacy Code (HIPC) and the Privacy Act 1993.

Who Do We Collect Your Personal Information From?

We generally collect your personal information directly from you. We will not collect your personal information from another source unless obtaining the information from you would undermine the purpose of collection, is necessary for a public sector body to uphold or enforce the law, or we have your permission to collect information from someone else.

If you provide us with personal information about another person, you are responsible for ensuring you have the authority to do so and that the person consents to our collection and use of their personal information.

What Personal Information Do We Collect and Why?

Ngā Hua Pharmacy collects certain personal information about you to fulfill our role as a pharmacy and to comply with legal requirements. This information may include:

  • Your name, date of birth, NHI number, and address
  • GP details and medication history
  • Information related to your prescriptions, including Section 29 unapproved medicines

We collect this information to:

  • Dispense medications safely and legally
  • Update your My Medicines List and manage repeats and new prescriptions
  • Notify Medsafe of supplies of Section 29 unapproved medicines, as required by the Medicines Act 1981

For Section 29 unapproved medicines supplied through our website, your details, as required by law, will be recorded and reported to Medsafe to ensure traceability and accountability. These records are subject to audit by Medsafe.

Consent for Communication

By registering and enrolling on our website, you agree to receive communications from us regarding Section 29 unapproved medicines relevant to your treatment. These communications are necessary for the ongoing management of your treatment as an enrolled patient.

Do I Have to Provide Personal Information?

You may choose not to provide your personal information. However, if you do not agree to provide the necessary information, we will not be able to provide you with our pharmacy services.

Storing Your Personal Information

Ngā Hua Pharmacy takes reasonable steps to securely hold your information and keep it safe from loss, unauthorized activity, or other misuse. Your personal information is stored in our secure storage facilities and with cloud providers that comply with the Health Information Security Framework (HISO) guidelines outlined by the Ministry of Health.

Disclosing Your Personal Information

We may disclose your personal information to:

  • Your general practitioner
  • Authorized third-party service providers to assist in providing goods or services to you
  • Governmental agencies or law enforcement if required by law

We will not disclose your personal information to marketing companies.

Accessing and Correcting Your Personal Information

Subject to certain grounds for refusal set out in the Privacy Act 1993, you have the right to access your personal information that we hold and to request corrections. To access or correct your personal information, please contact us. We may require evidence to confirm your identity before proceeding with your request.

Limitation of Liability and Indemnity

To the fullest extent legally permissible, Ngā Hua Pharmacy’s total liability, including that of its officers, employees, and agents, arising from or in relation to these Terms and the supply of goods and services, is limited to the total amount paid by you for the goods and services giving rise to the claim for liability.

Severability

If any provision of these Terms is found to be illegal or unenforceable, it shall be deleted or limited to the minimum extent necessary, and the remainder shall remain in full force and effect.

Applicable Law

These Terms are governed by the laws of New Zealand, and any disputes arising from them will be subject to the jurisdiction of the New Zealand courts.
